Introduction

By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy available at www.trendfynd.com/privacy-policy. If you do not agree with these Terms, you must stop using the Services immediately. We may update these Terms from time to time, and the most recent version will always be available on our website, indicated by the “Effective Date” above. Continued use of the Services after any updates constitutes your acceptance of the revised Terms.

Eligibility and Accounts
You must be at least 18 years old and capable of entering into legally binding agreements to use the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect any unauthorized access or use of your account. TrendFynd reserves the right to suspend or terminate accounts that violate these Terms or applicable law.

Description of Services
TrendFynd provides analytics, monitoring, and insight tools that aggregate and process publicly available online and social media data obtained from authorized third-party vendors and data partners. TrendFynd does not directly scrape or extract data from social media platforms. All data provided through the Services originates from publicly available sources or from vendors who are responsible for collecting such data in compliance with applicable laws and platform terms. The Services are provided on an “as-is” and “as-available” basis, and we make no guarantees about the availability, completeness, accuracy, or reliability of the data or insights provided through the Services.

Subscription Plans and Payments
Access to the Services may require payment of subscription fees based on the plan you select. All prices are listed in U.S. dollars or other applicable currency and are processed securely through Dodopayments or other authorized payment processors. By subscribing, you authorize TrendFynd and its payment partners to charge the applicable fees on a recurring basis until you cancel your subscription. Subscription fees are non-refundable except where required by law. You may cancel your subscription at any time, and your access will continue until the end of your current billing cycle. TrendFynd reserves the right to modify subscription fees, plan features, or billing cycles with reasonable prior notice.

Acceptable Use
You agree to use the Services only in accordance with these Terms and all applicable laws. You must not access or use the Services for unlawful, harmful, or abusive purposes. You agree not to attempt to reverse engineer, decompile, or derive source code from the Services, or to circumvent any security features or rate limits. You must not use data obtained through the Services in a manner that violates privacy laws, intellectual property rights, or platform terms. Reselling, sublicensing, or redistributing TrendFynd data or reports without our written consent is prohibited. TrendFynd may suspend or terminate your account for any violation of this section.

Customer Content and Data
You may upload or configure data, keywords, or settings in your account (“Customer Content”). You retain ownership of all Customer Content you provide. By using the Services, you grant TrendFynd a limited, non-exclusive, worldwide license to process, display, and use such data as necessary to operate and improve the Services. TrendFynd may aggregate and anonymize usage information to enhance its analytics and develop new features, but we will never disclose identifiable Customer Content without your consent except as described in our Privacy Policy.

Marketing and Publicity
By signing up for TrendFynd, you grant us a limited, revocable, non-exclusive, royalty-free license to use your company name and logo for the purpose of identifying you as a customer on our website, landing pages, and marketing materials. You may withdraw this permission at any time by emailing adarsh@trendfynd.com, and we will remove your logo or reference within a reasonable period of time.

Intellectual Property
All intellectual property rights in and to the Services, including software, design, text, trademarks, and other materials, are owned by TrendFynd or its licensors. These Terms do not grant you ownership of any TrendFynd intellectual property or data except for the limited right to use the Services as described herein. You agree not to copy, modify, distribute, or create derivative works of any part of the Services without our prior written consent.

Disclaimer of Warranties
The Services and all related data and insights are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied. TrendFynd does not warrant that the Services will be uninterrupted, error-free, or free of harmful components, nor do we guarantee the accuracy or reliability of any data or insights provided. You use the Services entirely at your own risk.

Limitation of Liability
To the maximum extent permitted by law, TrendFynd and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill resulting from your use of or inability to use the Services. In no event shall TrendFynd’s total liability to you exceed the amount you paid to us in subscription fees during the twelve months preceding the event giving rise to the claim.

Indemnification
You agree to indemnify and hold harmless TrendFynd, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from your use of the Services, your Customer Content, or your violation of these Terms or applicable law.

Termination
You may stop using the Services at any time. TrendFynd may suspend or terminate your access immediately if you violate these Terms, fail to pay subscription fees, or engage in activity that may harm TrendFynd or other users. Upon termination, your right to access and use the Services will cease immediately. Sections of these Terms that by their nature should survive termination, including those relating to intellectual property, indemnification, limitation of liability, and governing law, will continue to apply.

Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, India. By using the Services, you consent to the personal jurisdiction and venue of such courts.
